Exclamation Bankruptcy problem

Hi

The problem is that one company owes some amount of money but he said he filed for bankruptcy. Now since I don't know is that true, how can I check this to be sure?
I was thinking on going to small claims court or collection agency, I have all paperwork/contracts etc..
Also they guy/his company is in different State. What do you suggest I do ?

Thanks

Hi,

You can demand that he sends you the copy of the bankruptcy papers. If you are on the list-you have no cause to collect. However, if he forgot to include you on it, then you still have a claim to the debt. If he included you on the list-you should have gotten a letter when he filed.

Depending on how much he owes you, then you can either take him to small claims add another ding on his credit-judgment besides the bankruptcy that will both linger from anywhere to 7-10 yrs.

Hope this helps.
